Estate Planning & Probate
The Texas Probate Code provides for the distribution of the estate of a person who dies without a will. However, intestate distribution is often more expensive than probating an estate through a well drafted Will. Wills enable clients to choose the guardians of their minor children, the administrators of their estates, and to establish trusts for young beneficiaries and those with special needs. A thorough estate plan may include inter vivos trusts, a Will (with testamentary trusts as may be necessary), directive to physician, powers of attorney, and designation of guardian. These plans are developed to minimize probate expenses and state and federal estate and gift taxes, and preserve estate assets.

Civil Litigation
Kelly, Morgan, Dennis, Corzine & Hansen, P.C. has a broad trial practice with emphasis on insurance defense and business litigation. Our mission is simple: to resolve a client's dispute successfully and economically. We start with a realistic assessment of the case. If the right path is negotiation, we are well-versed in litigation alternatives such as mediation and other alternative dispute resolution strategies. But when the path has to run through a courtroom, we have more trial experience than most litigation firms in West Texas, successfully litigating hundreds of cases for clients involving insurance defense and business disputes. From counseling through trial and appeal, our civil litigation practice team provides our clients with a comprehensive experience in all matters. The firm has managed cases involving:
- personal injury/wrongful death
- product liability
- premises liability
- toxic torts/asbestosis and silicosis claims
- contract disputes
- breach of fiduciary duty
- non-com petition/tortious interference with business
- appropriation of trade secrets
- deceptive trade practices
- collection of past due accounts
- construction disputes
Regardless of the claim, we manage a case the way you manage your business—with discipline and a constant eye on how to get to the best, most cost effective outcome. That's why our trial attorneys are consistently ranked among the best.

Bankruptcy & Ceditor's Rights
Attorneys in the firm's bankruptcy section represent secured lenders, including banks, credit unions and factoring companies, unsecured trade creditors, chapter 7 and 11 trustees, creditor's committees, as well as business and consumer debtors. We also frequently represent individuals interested in acquiring assets out of bankruptcy cases. In addition to handling formal bankruptcy proceedings, we frequently are engaged to represent clients in out-of-court workouts, loan restructuring and asset purchases.
We regularly counsel lenders and borrowers to resolve loan problems, including defaults, workouts, repossession, foreclosure and receivership. We also regularly consult with financially troubled individuals and companies prior to bankruptcy to arrange restructuring and reorganization transactions. We advise clients of their full range of options, taking into account each individual's or company's unique circumstances. We frequently negotiate forbearance agreements, loan restructurings and other out-of-court workouts.
Litigation is often a necessary component of the bankruptcy process, and we have long-term experience representing clients before the bankruptcy courts. Our experience includes both prosecuting and defending fraudulent conveyance actions and preference litigation, objecting to the discharge of individual debtors and obtaining relief from the automatic stay.
